Terms and Conditions
1. Scope
These Terms and Conditions apply to all GH-MAPPING services relating to fileservice, ECU optimization, TCU optimization, map editing, software adjustment and digital calibration files.
2. Provider
The provider is the operator named in the Legal Notice.
3. Scope of services
GH-MAPPING creates or edits digital files based on the original files, vehicle data, ECU data and requested adjustments provided by the customer. Type and scope of the service result from the respective request, offer or individual agreement.
Services may include Stage optimizations, DSG/TCU adjustments, Vmax adjustments, custom solutions, error correction or other calibration work.
4. Customer data and cooperation
The customer must provide all required information completely and correctly. This includes, in particular, vehicle model, engine, ECU, HW/SW version, original file, existing modifications, fault codes, hardware modifications, hardware condition and desired scope of performance.
GH-MAPPING accepts no liability for damage or malfunctions caused by incorrect, incomplete or misleading information.
5. Original files and file usage
The customer confirms that they are authorized to use and have the submitted files edited. The customer is responsible for securely backing up the original file and for correctly transferring the file to the vehicle.
GH-MAPPING is not liable for consequences arising from faulty reading, damaged files, incorrect flashing, unsuitable tools or interruptions during programming.
6. No guarantee for performance figures
Stated power, torque, consumption or comparison values are non-binding experience or example values. Actual results may vary depending on vehicle condition, software version, hardware, fuel quality, maintenance condition, measurement method and environmental conditions.
GH-MAPPING does not guarantee that specific horsepower, torque, consumption, acceleration or dyno values will be achieved.
7. Risk of vehicle damage
Software adjustments can increase the load on engine, turbocharger, clutch, gearbox, exhaust system, injection system and other vehicle components. Even with professional editing, defects, wear, consequential damage or pre-existing damage may become apparent.
The use of edited files is at the customer's own risk. GH-MAPPING assumes no warranty or guarantee for damage to the vehicle, engine, ECU, gearbox, drivetrain, exhaust system or other components to the extent permitted by law.
8. Legal use and road approval
The customer is solely responsible for whether a software adjustment is permitted for use on public roads. Changes may affect operating permit, insurance coverage, emissions behavior, warranty claims or manufacturer specifications.
Services that are not permitted for public road use may only be used within the legally permitted framework, for example for motorsport, export, dyno or off-road purposes.
9. Emissions, DPF, EGR and AdBlue solutions
Requests relating to emissions systems, DPF, EGR, AdBlue or similar functions are handled only within the limits of legal permissibility. The customer is responsible for place of use, vehicle use, road approval and compliance with all applicable regulations.
10. Review and complaints
The customer must check delivered files immediately after receipt and before use for plausibility, vehicle assignment and technical usability. Complaints must be submitted without delay with a comprehensible error description, original file, modified file, fault codes and relevant logs.
Rectification requires that the issue is reproducible and related to the delivered file.
11. No liability for third-party work
GH-MAPPING is not liable for damage or problems caused by third-party work, including workshops, flashing service providers, tuners, diagnostic tools, faulty hardware, previously modified software or unsuitable vehicle condition.
12. Prices and payment
Prices are based on the respective offer or individual agreement. The service is usually provided only after payment or agreed release. Digital files may be excluded from withdrawal after creation and provision if the statutory requirements are met.
13. Limitation of liability
GH-MAPPING is fully liable in cases of intent, gross negligence and injury to life, body or health. Otherwise, liability is limited, to the extent permitted by law, to foreseeable damages typical for the contract.
Liability for indirect damages, consequential damages, lost profit, loss of use, dyno deviations, reduction in value, loss of warranty, operational downtime or damage caused by improper use is excluded to the extent permitted by law.
14. Intellectual property
Edited files, calibrations, map changes and technical solutions remain, where legally possible, the intellectual property of GH-MAPPING. The customer receives a simple right of use for the specifically commissioned vehicle or ECU.
Forwarding, selling, copying or using the files for other vehicles is not permitted without GH-MAPPING's consent.
15. Privacy
Information about the processing of personal data can be found in the Privacy Policy.
16. Final provisions
German law applies. If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected.
